Brian Cafritz

Managing Partner, Restaurant & Retail Litigation Group

Robert came to law as a second career committed to the idea that excellent skill, knowledge, and representation are not just a goal, but an absolute requirement.  As Managing Partner of KPM LAW’s Fairfax Office, Robert put together and manages an aggressive team of litigation professionals committed to aggressive, efficient and responsive promotion of client interests.

Robert focuses his practice on the defense of large loss and complex commercial and construction claims, contract disputes, professional and business liabilities, commercial transportation accidents, and premises liability, as well as insurance coverage analysis and litigation.  He has tried numerous cases in both state and federal courts and has successfully argued in the appellate courts of Virginia, Maryland and the Fourth Circuit.

After graduating from the University of Virginia, Robert received a full scholarship to study opera at the Academy of Vocal Arts in Philadelphia.  He sang for ten years on stages from the east coast to Chicago before returning to law school at the College of William and Mary, where he took second place in William Mary’s National Moot Court competition and was a member of the I’Anson-Hoffman Inns of Court.  Robert is happily married and also manages his boy-girl twins and a wonderful mixed-breed, rescue dog.

Brian has been an invaluable member of the KPM LAW team since 1994; his commitment having helped solidify and expand the foundation of KPM LAW's regional defense network. He has an AV+ rating on Martindale Hubbel, has been selected to Legal Elite, and has been named to SuperLawyers every year since 2016.

Brian primarily focuses his practice on the defense of Fortune 500 companies that operate under large self-insured retentions. With bar licenses in four jurisdictions, he has built a dedicated team and developed an efficient system that allows him to aggressively defend all matters in a regional practice that covers the entire mid-Atlantic region.

As Brian's practice became more focused on Retail and Restaurant litigation, it became evident to him that the Plaintiff's bar was more organized in sharing its resources, and so in 2006 – 2007, Brian co-founded the National Retail and Restaurant Defense Association (NRRDA) to promote the education and communication channels of industry leaders and counsel. Brian was elected to serve two terms as the association's first president. Under Brian's leadership, NRRDA continued to grow. Today, NRRDA boasts over 800 members and is seen as a leader in the Retail and Restaurant sector. He continues to serve on NRRDA's Board of Directors and guides the association as the issues that the industry faces continue to evolve.

In addition, as Brian's focus on Sports and Entertainment law became more prominent, in 2022 he was invited to be part of the founding Advisory Board of the Sports and Entertainment Risk Management Alliance (SERMA). He still serves as a SERMA Board member and has become a national leader in Youth Sports and is heavily involved in defending various professional leagues, franchises, facilities, and event organizers. Brian is well versed in and often works in claims involving SafeSport, abuse, hazing, bullying, discrimination, defamation, defective equipment, facility failures, and event security. Brian is a regular public speaker and often speaks on Youth Sports topics at national conferences on Claims and Risks in Youth Sports.

Brian has also been honored to be the only Virginia attorney selected to be a member of IALDA, a defense network dedicated to the defense of the Amusements and Leisure industry.

Today, Brian's practice focuses on General Liability claims with specialty in Retail, Restaurant, Sports, Entertainment and Amusement matters, as well as representing many other commercial and SIR clients, including Public Utilities, Aviation-related, and Construction Companies.

When he is not fighting the good fight, Brian enjoys playing guitar and cheering on his beloved University of Virginia Cavaliers in every sport. As always, GO HOOS!
