A good personal injury attorney will help the injured person better understand the steps taken with an insurance company.  If you choose not to seek legal representation, it is likely an insurance company will attempt to process your claim very quickly.  When a claim is processed quickly, many key elements of the claim are not brought to the forefront of the case, and the injured may not receive what he/she deserves.  When working with an insurance company, the injured people are not always told they have up to two years to prepare the claim prior to filing.  

A personal injury attorney will also guide you in what information to disclose, and what not to disclose to an insurance company.  Oftentimes, the insurance company is the first to contact the injured party after an accident, and this is to get a recorded statement.  What many people who have just been involved in an accident do not know is that you should never immediately give a recorded statement.  It is likely that after an accident, the injured person is more talkative, more emotional and may share more information because of these intense feelings.  Whatever you say will be used later in the courtroom, and statements to insurance companies can not be omitted in court after they are recorded.  If you feel you must give a statement, you may comply, but it is in your best interest to ask that it not be recorded.

In addition, an insurance company will want the injured person to authorize the disclosure of personal records, i.e. medical, personnel, etc… You will not benefit from sharing this kind of information.  Even after a personal injury your privacy should be of concern to you.  Be specific and cautious on what you authorize an insurance company to obtain. A personal injury attorney will advise you to obtain the records yourself, and be selective in what you choose to share.  

Seeking advice from a personal injury attorney is the safest approach to ensure you and your family are protected, and you receive the compensation you deserve before working directly with an insurance company.  They will council you on what you should disclose to the insurance company and how to go about getting them the information they need to process your claim.  Do not avoid the insurance company entirely; however, a personal injury attorney will provide sound legal advice on how best to proceed with your claim in the event you are injured.
